Summary of Allegations

As a result of a referral by the Inquiries, Complaints and Reports Committee, it is alleged that Alamgir Hallan, while engaged in the practice of pharmacy  as owner, director, shareholder, and/or pharmacist at Fort William Medical Pharmacy in Thunder Bay and/or Dixie Medical Pharmacy in Mississauga, Ontario (collectively, the “Pharmacies”)  committed professional misconduct in that he:

  • Sold by wholesale, distributed, and/or exported (or permitted, consented to, or approved, expressly or by implication, the sale by wholesale, distribution, and/or exportation of) drugs to a person and/or business in Trinidad and Tobago without a drug establishment license and/or where the drugs were intended for sale and consumption in Canada and not intended for export, including certain identified drugs;
  • Sold (or permitted, consented to, or approved, expressly or by implication, the sale of) drugs to a person and/or business in Trinidad and Tobago without a valid authorization from a prescriber, including certain identified drugs;
  • Failed (or permitted, consented to, or approved, expressly or by implication, the failure) to keep adequate records regarding the sale, wholesale, distribution, and/or export of drugs to Trinidad and Tobago, including certain identified drugs;
  • Failed (or permitted, consented to, or approved, expressly or by implication, the failure) to maintain records for Dixie Medical Pharmacy for at least 10 years following the closure of the pharmacy; and/or
  • Failed to exercise appropriate oversight of one or both of the Pharmacies. 

In particular, it is alleged that he:

  • Failed to maintain a standard of practice of the profession;
  • Failed to keep records as required respecting his patients and/or practice;
  • Contravened (or permitted, consented to, or approved, expressly or by implication, the contravention of):
    • sections 155, 160, 163, and/or 166 of the Drug and Pharmacies Regulation Act; and/or,
    • sections 18, 19, 20, and/or 21 of Ontario Regulation 264/16;
  • Contravened (or permitted, consented to, or approved, expressly or by implication, the contravention of):
    • section 37 of the Food and Drugs Act; and/or,
    • sections A.01.048 and/or C.01A.004 of the Food and Drug Regulations;
  • Permitted, consented to, approved, counselled, or assisted, whether expressly or by implication, the commission of an offence against any Act relating to the practice of pharmacy or the sale of drugs, including:
    • sections 155, 160, 163, 165, and/or 166 of the Drug and Pharmacies Regulation Act;
    • sections 18, 19, 20, and/or 21 of Ontario Regulation 264/16;
    • sections 31 and/or 37 of the Food and Drugs Act; and/or,
    • sections A.01.048 and/or C.01A.004 of the Food and Drug Regulations;
  • Engaged in conduct or performed an act relevant to the practice of pharmacy that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable and/or unprofessional.
