Summary of Allegations
As a result of a referral by the Inquiries, Complaints and Reports Committee, it is alleged that Farah Thawer, while engaged in the practice of pharmacy as director, Designated Manager, pharmacist, and/or in any other capacity at FGC Health LP, Hilary’s Agencies Limited, Hilary’s Pharmacy, Danforth Central Pharmacy and/or Bradford Central Pharmacy (collectively the “Pharmacy Entities”) committed professional misconduct in that she:
- Failed to keep confidential personal health information or other personal information concerning a patient by identifying patients, medications and/or physicians in a video that was posted to a publicly accessible website and continued to be available to the public as of February 13, 2025 and beyond;
- Restricted (or directed, consented to, or approved, expressly or by implication, the restriction of) access to all or parts of the electronic medical records of patients from pharmacists and/or pharmacy professionals in a manner that interfered with patient care and/or had the potential to interfere with patient care;
- Directed (or permitted, consented to, or approved, expressly or by implication), a non-pharmacist to bill for pharmaceutical products and/or services under the name and/or login credentials of a pharmacist;
- Submitted (or directed, consented to, or approved, expressly or by implication, the submission of) claims for payment to the Ontario Drug Benefit Program for pharmaceutical products (including, but not limited to, Naloxone) and/or services (including but not limited to MedsChecks) that were never dispensed, conducted and/or were non-compliant with the requirements set forth by the Ministry of Health;
- Falsified (or directed, consented to, or approved, expressly or by implication, the falsification of) records relating to pharmaceutical products (including, but not limited to, Naloxone) and/or services (including but not limited to MedsChecks);
- Failed to (or directed, consented to, or approved, expressly or by implication, the failure to) keep records and/or documentation as required for pharmaceutical products (including, but not limited to, Naloxone) and/or services (including, but not limited to, MedsChecks);
- Practiced the profession while in a conflict of interest and/or participated in an arrangement that constitutes a conflict of interest as defined in Part II of Ontario Regulation 130/17 with respect to the billing of pharmaceutical products (including, but not limited to, Naloxone) and/or services (including but not limited to MedsChecks); and/or,
- Pressured and/or induced (or directed, consented to, or approved, expressly or by implication, the pressure or inducement of) pharmacy professionals and/or employees to bill for pharmaceutical products and/or services in a manner that placed the financial interests of herself and/or the Pharmacies ahead of the interests of patients, contrary to standards of practice and the Ontario College of Pharmacists Code of Ethics.
In particular, it is alleged that she:
- Failed to maintain a standard of practice of the profession;
- Practiced the profession of pharmacy while in a conflict of interest and/or participated in an arrangement that constitutes a conflict of interest;
- Failed to keep records and/or documentation as required;
- Falsified a record relating to her practice and/or a person’s health record;
Signed and/or issued, in her professional capacity, a document that she knew or ought to have known contained a false and/or misleading statement;
- Failed to keep confidential personal health information or other personal information concerning a patient, except with the consent of the patient or the patient’s authorized representative or as permitted or required by law;
- Submitted an account and/or charge for services and/or products that she knew or ought to have known was false and/or misleading;
- Engaged in conduct or performed an act relevant to the practice of pharmacy that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable and/or unprofessional.
