Hearing 4396 for Khalil, John Sabry Botros

Summary of Allegations

As a result of a referral by the Inquiries, Complaints and Reports Committee, it is alleged that John Sabry Botros Khalil, while employed as the Designated Manager of the Pharmacy, and/or as director and/or shareholder of the corporation that operated the Pharmacy at Rideau Clinic Pharmacy in Ottawa, Ontario (the “Pharmacy”), committed professional misconduct in that he:

• Between the 1st day of March in the year 2024 and the 15th day of July in the year 2024, he failed to maintain or update records or documentation pertaining to administered doses of methadone;
• Between the 1st day of March in the year 2024 and the 15th day of July in the year 2024, he failed to maintain or update records or documentation pertaining to missed doses of methadone;
• On or about the 16th day of July in the year 2024, he failed to perform a check for therapeutic appropriateness before dispensing medication, namely Dilaudid, for [Patient 1];
• On or about the 16th day of July in the year 2024, he failed to perform a check for therapeutic appropriateness before dispensing medication, namely Dilaudid and Kadian, for [Patient 2];
• On or about the 16th day of July in the year 2024, he dispensed, (or permitted, consented to, or approved, expressly or by implication, the dispensing of) drugs in a container without the identification markings as required by s. 156(3) of the Drug and Pharmacies Regulation Act, RSO 1990, c. H. 4.

In particular, it is alleged that he:

• failed to maintain a standard of practice of the profession;
• failed to keep records as required respecting his patients or practice;
• contravened the Act, the Drug and Pharmacies Regulation Act, the Regulated Health Professions Act, 1991, the Narcotics Safety and Awareness Act, 2010, the Drug Interchangeability and Dispensing Fee Act or the Ontario Drug Benefit Act or the regulations under those Acts, and in particular, s. 156(3) of the Drug and Pharmacies Regulation Act, RSO 1990, c. H. 4;

engaged in conduct or performed an act relevant to the practice of pharmacy that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable or unprofessional.
